Open-Source AI Governance
The governance of open-source AI models, those where weights are publicly released, is one of the most contested areas of AI policy. Open-weight models enable broad access and innovation but remove the ability of developers to control downstream use. A model released openly cannot be recalled, patched centrally, or restricted to approved use cases after the fact.
The EU AI Act includes provisions for open-source GPAI models with reduced obligations compared to commercial providers, but details are still being worked out through delegated acts. US AI policy debates have increasingly focused on whether open-weight models above certain capability thresholds should face restrictions.
