Recording Consent

Recording consent refers to the legal requirement that people be told, and in many cases agree, before a conversation is recorded or transcribed. It matters for AI governance because AI tools that capture meetings, customer calls, or voice interactions can create recordings that trigger wiretap and eavesdropping laws. Those laws differ sharply by jurisdiction: some U.S. states require every party's consent, while others need only one party's, and the EU and UK impose their own data protection rules on any recording that identifies a person.
