Preemption
Preemption refers to the legal question of whether federal law overrides state laws on the same subject, and in AI it has become central to the debate over who gets to regulate the technology in the United States. Proposals to bar states from enforcing their own AI rules for a set period have repeatedly surfaced in Congress and in executive actions, while states such as Colorado, California, and New York continue to pass their own requirements. For compliance and risk teams, the outcome determines whether they must track a patchwork of state obligations or whether a single federal standard could eventually replace them.
