Strict Liability

Strict liability is a legal doctrine under which a party can be held responsible for harm without anyone needing to prove that it was negligent or intended the harm. In AI governance, this matters because lawmakers and courts are increasingly debating whether developers or deployers of AI systems should face strict liability for damage caused by autonomous or high-risk outputs, which would shift the burden away from plaintiffs and make documentation, testing, and insurance coverage central to a company's risk position.
