Criminal liability is the legal responsibility an individual or organization faces when their actions violate criminal law, as opposed to civil law. In AI governance, this becomes relevant when decisions made by or about AI systems—such as deliberately deploying a biased lending algorithm, concealing safety failures, or using AI to commit fraud—cross the threshold from negligence into intentional wrongdoing or reckless endangerment.
